BabyEase, Cotswolds Baby Equipment Hire – Terms and Conditions

Please read these terms and conditions carefully before using our services.
Definitions
For the purposes of these Terms and Conditions:
“Renter” means the responsible adult renting equipment from BabyEase.
“We” & “Us” means BabyEase.
“Equipment” means any product supplied by BabyEase.
“Guardian” means responsible adult in charge of intended user.
“Intended user” & “User” mean the child equipment is being rented for.
- Agreement Overview
- By renting equipment from BabyEase you agree to the terms and conditions outlined below.
- BabyEase reserve the right to change or amend these terms and conditions at any time.
- All equipment is and will always remain the property of BabyEase.
- The renter may not sublease, loan or lend the equipment to any person or party.
- This agreement constitutes the entire agreement between BabyEase and the renter, and supersedes all prior and contemporaneous agreements, proposals or representations, written or oral, concerning its subject matter.
- No modification, amendment, or waiver of any provision of this agreement shall be effective unless in writing and signed by the party against whom the change is to be asserted.
- Rental Period
- The rental period commences and concludes on the dates stated on your invoice. Rented equipment may not be used outside of these specified dates.
- Booking and Payments
- To secure a booking, a non-refundable deposit is required.
- Full payment is due 14 days prior to the rental period commencing.
- Payments can be made through PayPal, Stripe or Bacs.
- Subject to Availability, BabyEase also offers the following chargeable optional services:
- Delivery and Collection
- Equipment Set-Up and Demonstration
- Rental Extension
- Rental Amendments or additional equipment.
- Services laid out in item 3.4 above can be purchased, using the contact information on our website, anytime from the point of order thought to 7 days before commencement of the rental period and must be paid in full before they can be used.
- Late returns: For equipment not returned or available for collection on the day the rental period ends, a £10 late fee will be charged each day the equipment is not returned.
- Equipment returned early for any reason are not eligible for a refund for unused time.
- Upon receipt of the order, we will confirm the booking by email. This confirmation should be checked thoroughly by the renter and any errors, omissions or queries sent to BabyEase 14 days prior to the rental period commencing or within 24 hours of receiving the booking confirmation. If we receive no such notification, we will assume the details of the confirmation are correct and delivery or collection will be booked as agreed.
- Collection and Drop-off
- Collection and Drop-off are available free of charge.
- The renter can collect the equipment on the day the rental period commences at a time convenient to both the renter and BabyEase at BabyEase’s premises.
- The renter can drop-off the equipment on the day the rental period ends at a time convenient to both the renter and BabyEase at BabyEase’s premises.
- Delivery and Return
- Delivery cost includes the return postage of the equipment.
- Express delivery is available for an additional fee.
- BabyEase or one of our delivery partners will deliver and collect the rented items to/from one specified address.
- BabyEase will ensure items are delivered on or before day the rental period commences.
- If BabyEase is unable to complete delivery due to unforeseen circumstances, within BabyEase & their delivery partners control, a refund will be arranged.
- Return instructions will be emailed to the renter and BabyEase will arrange for the equipment to be collected on or after the day the rental period ends
- It is the responsibility of the renter to ensure the address they have provided is correct.
- It is the responsibility of the renter to ensure they are available for delivery and collection.
- Additional charges may apply for failed or re-attempted deliveries &/ or collections.
- Availability
- All Rentals are subject to availability.
- On the rare occasion one of our sold-out products is returned Late or damaged and a replacement cannot be sourced in time for the rental; we will contact you to discuss a suitable alternative. If a suitable alternative can-not be agreed a full refund will be offered.
- Equipment Condition
- BabyEase will provide all equipment clean and in good working order without damaged. Some marks due to general wear and tear are to be expected.
- BabyEase’s safety and cleaning protocol begins with a rigorous quality assurance inspection of each item after every hire to ensure it functions safely and per its design items that do not meet these specifications are removed from our inventory and repaired or replaced as needed.
- The Equipment is cleaned thoroughly between every rental. We use a variety of cleaning products and materials that are child safe, eco-friendly and less harmful to the environment.
- The renter acknowledges, by collecting the equipment or accepting delivery, that all rented equipment is present and in good condition at the time rental period commences.
- If the equipment is inflatable item from us such as a Plane Pal, the renter must inflate the equipment to check for any punctures caused during transit.
- If equipment is missing or is delivered but arrives damaged the renter must make BabyEase aware within 24 hours of accepting delivery. This must be done by email.
- BabyEase will use all reasonable endeavours to replace missing or damaged equipment. If we are unable to replace or repair the equipment, we will offer a refund equal to the remaining, unused part of the rental period.
- Cancellation Policy
- Cancellations made over 14 days prior to the rental period commencing will receive a full refund.
- Cancellations made within 14 days of the rental period commencing are non-refundable.
- If notified 7 days prior to the rental period commencing, we can postpone the rental within 12 calendar months of the original rental period commencement date.
- Liability, Responsibilities and Waiver
- The renter will be liable for any breach of this Agreement.
- BabyEase takes all reasonable precautions to ensure equipment is safe to use & in good working order, however we cannot accept liability for how it is made (ultimate responsibility lies with the manufacturer) or how it is used (responsibility lies with the renter & legal guardian of the child/children), therefore we as an intermediary accept no liability for accidents or damage to property nor loss, damage, injury or death to any person arising in connection with the possession, operation or use of the equipment by the renter or other persons including without prejudice the failure of the equipment.
- BabyEase shall not, under any circumstance, be liable for any consequential, exemplary, special, incidental or punitive damages claimed by any party under the terms of or due to any breach of this Agreement.
- The renter indemnifies BabyEase against any loss or damage which may occur to the equipment or otherwise (including legal costs) in relation to any breach of this agreement by the renter.
- The renter, indemnifies, defends and holds harmless BabyEase from and against any claims, demands, losses, damages, punitive damages, costs, expenses, liabilities, causes of action, judgements of any kind or character including, without limitation, any interest, penalty, reasonable legal fees and other costs and expense incurred in connection or with the defence of all liabilities and obligations or alleged or threatened liabilities and obligations caused by, related to, attributable to or arising out of the operation and use of the equipment by the renter, including any property damage or personal injury, except to the extent caused by BabyEase’s gross negligence or wilful misconduct.
- The provisions of this clause shall survive the termination of this Agreement with respect to any claims or liability accruing before such termination. Subject to the provisions of the Unfair Contract Terms Act 1977 (as amended) BabyEase is not responsible for any direct or indirect damage, injury, loss, claim, cost or expenses (including inconsequential loss) incurred by the renter or any other person arising out of the renter’s, or any other person’s use of the equipment
- The renter is responsible for reading the manufacturer’s instructions carefully prior to using the equipment. If you need a copy of the manufacturer’s instructions, please make us aware at time of booking.
- The renter is responsible for ensuring that the equipment is used in accordance with UK safety guidelines & the manufacturer’s instructions. If you need a copy of the guidelines, please make us aware at time of booking.
- The renter is responsible for ensuring that the equipment is used in a safe and sensible manner.
- All equipment rented is to only be used by the intended user, for the purpose for which it is supplied. The renter is to provide adequate supervision. If additional children will be using equipment, then BabyEase must be informed prior to rental period commencing.
- Renting equipment does not entitle you to use with children for whom you are not the legal guardian. Doing so requires a separate booking & we cannot accept any liability for usage by persons or families outside of the booking.
- Rented equipment must only be used with BabyEase supplied accessories and may not be used in conjunction with any other products that effects the equipment’s use, operation or function.
- If during the rental period the equipment becomes faulty, damaged, or stops working properly the renter should immediately discontinue use and report the problem to BabyEase.
- No waiver of any breach of any term or condition of this agreement shall be binding unless in writing and signed by the party waiving the breach.
- The failure to enforce any condition of this agreement shall not be construed as a waiver of any such condition, nor prevent a party thereafter from enforcing the condition or any other condition of this agreement.
- Should any conditions of this agreement be determined to be void, invalid, unenforceable or illegal for whatever reason, such condition(s) shall be null and void; the remaining conditions of this agreement shall be unaffected and shall continue to be valid and enforceable.
- Lost, Stolen or Damaged Equipment
- The renter must obtain adequate insurance equal to the full recommended retail price of the rented equipment to cover loss or damage.
- The renter has full responsibility for the care and safekeeping of the equipment and will always retain it in their possession and under their control.
- The renter must not use or store the equipment in a manner likely to cause or inflict damage to the equipment. Where provided the equipment must always be stored in its dust bag.
- The equipment should be returned in a similar condition to the condition the renter received it in, prior to the rental period commencing. Except for normal wear and tear. The renter is not responsible for any pre-existing damage to the equipment that has already been identified.
- Under no circumstance will BabyEase repair, attempt to repair or service the equipment. If the equipment is damaged during the rental period in a way that effects the equipment’s function, use or safety, BabyEase will either send it to the original manufacture for repair, or it will be removed from our inventory and be replaced. The renter will be responsible for full cost of this process. This includes labour, materials, parts, VAT, and delivery charges.
- The costs to repair any damage to the equipment during the rental period will be the responsibility of the renter. This includes labour, materials, parts, VAT, and delivery charges.
- The costs to repair any damage incurred during transit due to the items being incorrectly or inadequately packaged by the renter will be the responsibility of the renter. This includes labour, materials, parts, VAT, and delivery charges.
- Where damaged equipment is not repaired by the manufacturer or the repair is un-economical, the renter will be responsible for full replacement cost (at the current recommended retail price) of the equipment.
- Under no circumstance should the renter repair, attempt to repair, service or replace any parts on the equipment, in this event the equipment will be removed from our inventory and replaced, and the renter will be responsible for full replacement cost (at the current recommended retail price) of the equipment.
- The renter will immediately inform BabyEase of any loss, destruction or theft of the equipment so we can take any appropriate action.
- The renter is responsible for the full replacement cost (at the current recommended retail price) of any equipment lost or stolen during the rental period.
- Non-return of equipment
- If equipment is not returned, BabyEase reserves the right to take any and all necessary actions (including law enforcement and legal action) to locate, recover and regain possession of the equipment.
- The renter will be responsible for and agrees to pay all costs in relation to locating, recovering and regaining possession of the non-returned equipment.
- If recovery of the non-returned equipment is not possible, the renter will be responsible for and agrees to pay all costs as set out in 11.2 in addition to the full replacement cost (at the current recommended retail price) of the equipment.
- If the renter breaches the Terms of this Agreement by not returning the hired equipment or not paying for the cost of replacing the equipment, BabyEase reserves the right to take any and all measures necessary (including lawfully entering upon the renter’s premises and repossessing the equipment or otherwise) to terminate this agreement at any time. Any expense incurred by the Owner in the recovery of the equipment or any fees or expenses payable by the renter under this contract shall be payable in full by the renter. Payment of any lesser sum than the amount due shall not discharge the Hirers obligations under this agreement.
- Cleaning
- Equipment must be returned in a dry and sanitary condition.
- Additional cleaning charges may apply if equipment is returned in with any new marks, scratches, stains or in a wet condition.
- Refunds
- Any refund due must be agreed by BabyEase in writing.
- Any refund due will be made within 7 calendar days from the date on which we agree that the renter is entitled to a refund.
- Refunds will be made using the original payment method.
- Termination
- This agreement will terminate on the date specified on the order confirmation.
- BabyEase shall be entitled at any time, if the renter is in breach of these Terms and Condition, to terminate this agreement (such termination to be effective immediately) and to repossess the equipment.
- Amendments to Terms and Conditions
- BabyEase reserves the right to amend this agreement and terms and conditions at any time.
- Amendments will be effective immediately upon publication on this website.
- Governing Law and Language
- These terms and conditions are written in English are governed by the laws of England and Wales.
- Jurisdiction to settle any dispute which may arise out of or in connection with this Agreement sits with the English Courts and legal system, and accordingly any proceedings may be brought in such courts.

- Whilst every precaution has been taken in the preparation of this agreement BabyEase assumes no responsibility for errors and omissions
- BabyEase accepts no liability for accident, damage or loss resulting from the use of the information contained within this agreement.

- Defamation & Libel
- A defamatory statement is one which is false and causes damage to a person or businesses reputation or otherwise does harm. Libel is the term given to defamation in a permanent form, such as print. We strive to ensure all of our customers are happy with their rental experience. If for any reason you are unhappy with any aspect of our products or services, we ask you contact us first so we can resolve the issue in a timely manner. We take any false statements or accounts regarding BabyEase and the service we provide seriously and will pursue any Libel or Defamatory comments via the court of law.
